Today, cities routinely give developers
condemnation powers in tax increment financing (TIF) areas.
Typically, targeted properties are being condemned for
retail development in so-called blighted areas.
Issues
arising with giving private developers access to condemnation
powers include the "blighting", the alleged
public purpose, and the amount of compensation. Property owners
and tenants must take steps early in the process to protect
their interests in these for-profit developments.
