Condemnation Law Primer
The most common question asked by property owners relates to what compensation they are entitled to under the law. In Missouri, new laws were enacted in 2006, affecting valuation and compensation. Knowledge of that law by a condemnation attorney is paramount. If your property is taken through condemnation, you are entitled to "just compensation." Fair market value is determined for the entire property. If a portion of the property is taken, you may be entitled to damages relating to the remaining portion of the land. You have the right to be paid for the "highest and best use of the property," and not just the existing use.
The condemnation process is complex and can be lengthy. Handling such matters on your own is unwise and can lead to serious compromising of your rights. The legal process of condemnation starts with a hearing where we are sometimes able to challenge the government's right to condemn your property. After the hearing, if the right to take your property is approved, the court appoints three “commissioners” to determine your compensation. The government can take your property by paying you the amount established by the court commissioners, but you still have a right to request a jury trial for a final determination of value and compensation. At any time during the process, there is always the possibility of a settlement.
