After the Commissioners' Hearing, the commissioners then report their opinion of compensation to the court. Their report is referred as the"Commissioners Award". Upon receipt of this report, the government (condemnor) usually deposits the amount of the award with the court, at which time, the government takes title to the property. The property owner would then obtain these funds from the court, subject to payment of liens, mortgages, taxes or judgments, but may remain in possession of the property for a period afterwards. Even if a jury is to occur at a later time, thereby placing the Commissioners' Award at risk, the property owner is free to spend the Commissioners' Award immediately upon receipt. After ten (10) days following deposit of the Commissioners' Award with the court, the government may ask the court to transfer possession and the court may allow no longer than ninety (90) days for the property owner to remain in possession.
