The issue before the jury is how much compensation the property owner will receive as a result of the condemnation. You are entitled to the value of what is taken together with any damages to the remaining property if the condemnation removes only a part of your property. The jury is not told of the Commissioners' Award, the amount of real estate taxes, or the amount you have the property insured. Often experts, such as real estate appraisers, testify at the trial. If the jury comes back with an amount in excess of the Commissioners' Award, then the government pays the excess money together with interest. If the jury comes back with an amount below the Commissioners' Award, then the property owner pays the deficiency together with interest.
