Before resorting to condemnation, the government (the condemnor) must be authorized, by statute or ordinance, to take the property for a specific public purpose. The government must also try to buy the property from the property owner through good faith negotiations. Once a property owner rejects such an offer, the government can continue to negotiate or file with the court a petition to condemn the property.
