Condemnation Hearing

The formal condemnation process begins with the filing of the petition. The petition will be served with a date set for an initial hearing. At the initial hearing (often called the "condemnation hearing"), the only issue is whether the government has the right to condemn. In other words, the only issue is whether the condemnation is for a public purpose and is necessary, and whether the government made an unconditional, good faith offer to purchase the property being condemned. It is at this hearing that the property owner has the opportunity to challenge the government's right to condemn.
