Under the U.S. Constitution, eminent domain, also known as condemnation, is restricted to public uses and requires the payment of just compensation.   • Pre-condemnation planning – From relocation to compensation, many critical decisions are made before formal condemnation proceedings begin.   • Challenging the right to condemn - There are situations where it is necessary to challenge the right to condemn. This is especially true when the ultimate owner of your property in condemnation will be a private developer. In these situations, our job may be to stop the attempt to condemn your property. Also, there are situations where we seek to have the proposed taking moved to a different location.
  • Compensation – Typically, the most critical issue in condemnation is compensation. When the taking is for the entire property, we seek to insure that you are fully indemnified for your losses. When the taking is for part of the property, compensation is not only for the property taken, but for damages to the remaining property. In certain situations, we seek damages for business losses.
  • Private redevelopment - There are situations where a private redeveloper obtains the power to condemn. This is done in partnership with the local government and often entails "blighting" an area.
  • Relocation – A property owner is entitled to both compensation for the property and relocation benefits. Relocation benefits include financial assistance to move and reestablish at another site as well as assistance to find a new location. In some circumstances, business losses can be compensated as part of the relocation.
